Statutory period of warranty of construction liability

Defects in the construction and the obligation of the builder to respond to them in legal terms, is governed by the Spanish Building Code in force since 2000 by " Law Construction Planning " ( LOE ).

Warranty periods depending on the defects are:

A YEAR after the end of construction of the property:
Must be claimed within one year , damages or purely aesthetic and finish defects such as cracks in plaster for example.

THREE YEARS after the end of construction of the property:
This period covers damage or defects that may affect the functionality and livability of the property &/or building. Humidity , leaks or cracks for example.

TEN YEARS after the end of construction of the property:
This period covers damage or serious defects in design and planning that affect the structure , stability and security of the property &/or building.
